​​Ignite Store Policy Guidelines 1.0

A. RESTRICTED CONTENT

Provider acknowledges that the IGNITE platform will be available to customers of all ages and backgrounds and accept responsibility that the content of its Applications will comply with Applicable Law and not include, or provide access to, any of the categories of restricted content set forth below.

(b) No Applications will be provided to Harman or uploaded to IGNITE that promote violence, or incite hatred against individuals or groups based on race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other characteristic that is associated with systemic discrimination or marginalization.

(c) No Applications will be provided to Harman or uploaded to IGNITE that depict or facilitate gratuitous violence or other dangerous activities. 

(d) No Applications will be provided to Harman or uploaded to IGNITE were developed by or promote terrorist organizations, or include content related to terrorism, such as content that promotes terrorist acts, incites violence, or celebrates terrorist attacks. 

(e) No Applications will be provided to Harman or uploaded to IGNITE that lack reasonable sensitivity towards a natural disaster, atrocity, pandemic, death, or other tragic event. Applications with content related to such sensitive events are generally allowed if the content has EDSA (Educational, Documentary, Scientific, or Artistic) value or intends to alert users to or raise awareness.

(f) No Applications will be provided to Harman or uploaded to IGNITE that contain or facilitate threats, harassment, or bullying.

(g) No Applications will be provided to Harman or uploaded to IGNITE that facilitate the sale or manufacture of explosives, firearms, ammunition, or certain firearms accessories, including accessories that enable a firearm to simulate automatic fire or convert a firearm to automatic fire (e.g. bump stocks, Gatling triggers, drop-in auto sears, conversion kits), and magazines or belts.

(h) No Applications will be provided to Harman or uploaded to IGNITE that facilitate the sale of illegal drugs or prescription drugs without a prescription or provide instructions for the growing or manufacture of illegal drugs.

(i) No Applications will be provided to Harman or uploaded to IGNITE that facilitate the sale of marijuana or marijuana products, regardless of legality.

(j) No Applications will be provided to Harman or uploaded to IGNITE that facilitate the sale of tobacco (including e-cigarettes) or encourage the irresponsible use of alcohol or tobacco.

(k) No Applications will be provided to Harman or uploaded to IGNITE that include content that sexualizes minors or appeal to children but contain adult themes. If Harman becomes aware of content with child sexual abuse imagery, Harman will report it to the appropriate authorities and block its access to IGNITE.

2. Financial Services Content  

Applications shall not induce or expose users to deceptive or harmful financial products and services and must comply with Applicable Law. 

(a) No Applications will be provided to Harman or uploaded to IGNITE that allow for the trading of binary options.

(b) No Applications will be provided to Harman or uploaded to IGNITE that mine cryptocurrencies. 

(c) No Applications will be provided to Harman or uploaded to IGNITE that promote or offer personal loans which require repayment in full in 60 days or less from the date the loan is issued, regardless of whether the Application offers loans directly, is a lead generator, or connects consumers with third-party lenders.

(d) No Applications will be provided to Harman or uploaded to IGNITE that promote or offer loans where the Annual Percentage Rate (APR) is 36% or higher or otherwise above the maximum allowable interest rate for such offered loan, regardless of whether the Application offers loans directly, is a lead generator, or connects consumers with third-party lenders. 

3. Unapproved Products and Supplements 

Applications shall not promote or sell unapproved substances, irrespective of any claims of legality. 

(a) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell products that contain ephedra.

(b) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell products containing human chorionic gonadotropin (hCG) in relation to weight loss or weight control.

(c) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell Herbal and dietary supplements with active pharmaceutical or dangerous ingredients.

(d) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell supplements, pharmaceuticals or consumables that make false or misleading health claims, including claims implying that a product is as effective as prescription drugs or controlled substances.

(e) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell non-government approved products that imply that they are safe or effective for use in preventing, curing, or treating a disease or ailment.

(f) No Applications will be provided to Harman or uploaded to IGNITE that promote or sell supplements, pharmaceuticals or consumables that have been subject to any government or regulatory action or warning.

(g) No Applications will be provided to Harman or uploaded to IGNTIE that promote or sell supplements, pharmaceuticals or consumables that have names that are confusingly similar to a pharmaceutical or supplement or controlled substance.​

B. IMPERSONATION AND INTELLECTUAL PROPERTY

The IGNITE platform will respect brands and intellectual property. 

Provider accepts responsibility for the content of its Applications and agrees that its Applications shall not misuse the brands and intellectual property of others.  

​Provider must not remove, obscure or modify any copyright notices, trademarks or other proprietary rights notices, on or contained in any information or Materials on or obtained from IGNITE or within the Applications.

Provider shall not submit an Application if any version of its Application, in whole or in part, currently is or has been the subject of any suit, claim or demand asserting infringement, misappropriation or other violation of any third-party Intellectual Property Rights, rights of privacy and publicity, or other proprietary or legal rights, or the subject of a letter asserting that Provider needs a license under such third-party rights.

Provider further agrees to the following:

1. Impersonation 

Applications shall not use another’s Application or use another’s entity’s brand, title, logo, or name in a manner that may result in misleading or confusing users. 

(a) No Applications will be provided to Harman or uploaded to IGNITE that imply an endorsement, affiliation, or relationship with another entity where none exist.

(b) No Applications will be provided to Harman or uploaded to IGNITE that uses titles, headers and icons that are similar to those of existing products or services of a third-party.

(c) No Applications will be provided to Harman or uploaded to IGNITE that falsely claim to be the official Application of any famous person, established entity or third-party business, association or organization. 

2. Infringement 

Your Applications shall not infringe, or encourage or induce infringement by IGNITE customers, of the intellectual property rights of others (including trademark, copyright, patent, trade secret, and other proprietary rights).  

(a) No Applications will be provided to Harman or uploaded to IGNITE that infringe another’s copyright. Modifying copyrighted content may still lead to a violation of this policy and Providers may be required to provide evidence of their rights to use copyrighted content.

(b) No Applications will be provided to Harman or uploaded to IGNITE that induce or encourage copyright infringement, including but not limited to, any that allow users to download or stream copyrighted content such as music and video without authorization. 

(c) No Applications will be provided to Harman or uploaded to IGNITE that violate the Digital Millennium Copyright Act (DMCA) or induce or encourage others to violate the DMCA, including but not limited to, any that allow users to employ anti-circumvention measures to access copyrighted works.

(d) No Applications will be provided to Harman or uploaded to IGNITE that infringe another’s trademark including the unauthorized use of an identical or similar trademark in a way that is likely to cause confusion as to the source or origin of a product.  

(e) No Applications will be provided to Harman or uploaded to IGNITE that sell or promote for sale counterfeit goods, including goods that contain a trademark or logo that is identical to or substantially indistinguishable from the trademark of another and/or mimics the brand features of another’s goods in an attempt to pass themselves off as a third-party brand.

C. LISTINGS AND PROMOTIONS 

The IGNITE platform will respect its Applications and expects that listings and promotions by Provider for its Applications will be of the highest quality, not seek to artificially boost usage and avoid spamming or harassing IGNITE customers and End Users. 

1. Promotion  

Your Applications shall not directly or indirectly engage in or benefit from promotion practices that are deceptive or harmful to Harman, IGNITE, Harman or IGNITE’s customers or other Developers. 

(a) No Applications will be provided to Harman or uploaded to IGNITE by Provider that are promoted using deceptive ads on websites, platforms or applications.

(b) No Applications will be provided to Harman or uploaded to IGNITE by Provider that use promotion or installation tactics that redirect users to IGNITE or cause the download or Applications without informed user action.

(c) No Applications will be provided to Harman or uploaded to IGNITE by Provider that serve unsolicited promotions to users via SMS services.

2. Metadata 

Your Applications must not be use misleading, improperly formatted, non-descriptive, irrelevant, excessive, or inappropriate metadata. The description, provider/developer name, title, icon, screenshots, and promotional images for its Applications must be accurate and Provider agrees to provide a clear and well-written description of its Applications. Unattributed or anonymous user testimonials in the description of its Applications are prohibited.  

D. SPAM AND USER EXPERIENCE 

The IGNITE platform expects that its Applications will provide a basic degree of functionality and respect Harman’s customers and End Users of IGNITE. 

Provider shall ensure that its Applications will not crash, or cause IGNITE system failures and will not spam Harman’s customers and IGNITE users.  

Provider must use IGNITE only in a courteous and non-offensive manner.  

Provider’s Applications must not (i) cause IGNITE to be used for any fraudulent, malicious, or unauthorized purpose, nor to harass any person, (ii) engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of IGNITE, nor which, as determined by Harman, may harm Harman or IGNITE users or expose them to liability; (iii) use IGNITE in any manner that could disable, overburden, damage, or impair IGNITE; (iv) access systems, data or information not intended by Harman to be made accessible to Provider; or (vi) enable anyone else to do any of (i) through (iv);

1. Spam 

Its Applications shall not spam Harman’s customers or IGNITE users and will not send unsolicited messages to Harman’s customers or IGNITE users. 

(a) No Applications will be provided to Harman or uploaded to IGNITE by Provider that send SMS, email, or other messages to Harman customers or IGNITE users without giving the customer or user the ability to confirm the content and intended recipients.

(b) No Applications will be provided to Harman or uploaded to IGNITE by Provider whose primary purpose is to drive traffic to a website or provide a website to Harman’s customers and IGNITE users without permission.

(c) No Applications will be provided to Harman or uploaded to IGNITE by Provider that provide an identical or nearly identical user experience as other Applications already on IGNITE.  Your Applications should provide value to users through the creation of unique content.

(d) No Applications will be provided to Harman or uploaded to IGNITE by Provider whose primary purpose is to serve advertisements.

2. User Experience 

Your Applications shall provide a stable, engaging and responsive user experience. Provider will not provide to Harman, or upload to IGNITE, Applications that crash, force close, freeze, or otherwise function abnormally.

(a) Provider must allow IGNITE OEM Customers and End Users unlimited reinstalls of each Application distributed by Provider via IGNITE without any additional fee, provided however, that End Users will no longer have a right or ability to reinstall the affected Applications if Provider removes an Application from IGNITE.

(b) Provider may not change its obligation to deliver and support its Applications, even though it may remove an Application from IGNITE at any time, for End Users who have previously purchased or downloaded those Applications through IGNITE as the removal of Provider’s Applications shall not adversely affect the rights of those End Users.
